The FBI’s Blind Clinton Trust

Comey’s agents were forgiving about some incriminating evidence.

The closer we look at the FBI’s investigative file on Hillary Clinton’s emails, the more we wonder (“Wonder”?!?  The certainty of Comey’s complicity in Hillary’s crimes is WAY beyond “wondering”!) if Director James Comey always intended to let her off the hook. The calculated release before the long Labor Day weekend suggests political favoritism, and the report shows the FBI didn’t pursue evidence of potential false statements, obstruction of justice and destruction of evidence.

Mr. Comey’s concessions start with his decision not to interview Mrs. Clinton until the end of his investigation, a mere three days before he announced his conclusions. Regular FBI practice is to get a subject on the record early then see if his story meshes with what agents find. In this case they accepted Mrs. Clinton’s I-don’t-recall defenses after the fact.

The notes also show the G-men never did grill Mrs. Clinton on her “intent” in setting up her server. Instead they bought her explanation that it was for personal convenience. This helped Mr. Comey avoid concluding that her purpose was to evade statutes like the Federal Records Act. Mr. Comey also told Congress that indicting her without criminal intent would pose a constitutional problem. But Congress has written many laws that don’t require criminal intent, and negligent homicide (for example) has never been unconstitutional.

The FBI notes also blow past evidence that Clinton advisers may have engaged in a cover-up. Consider page 10 of the FBI report: “Clinton’s immediate aides, to include [Huma] Abedin, [Cheryl] Mills, Jacob Sullivan, and [redacted] told the FBI they were unaware of the existence of the private server until after Clinton’s tenure at State or when it became public knowledge.”

That’s amazing given that Ms. Abedin had her own email account on the private server. It is also contradicted by page 3: “At the recommendation of Huma Abedin, Clinton’s long-time aide and later Deputy Chief of Staff at State, in or around fall 2008, [ Bill Clinton aide Justin] Cooper contacted Bryan Pagliano . . . to build the new server system and to assist Cooper with the administration of the new server system.”

...The FBI’s kid-glove treatment of Mrs. Clinton raises serious doubts about the seriousness of Mr. Comey’s probe. His July 5 public rebuke of her “extremely careless” handling of secrets has masked that Mrs. Clinton and her aides were given a pass on much of their behavior and dubious answers. The entire episode is another Jim Comey scar on the FBI’s reputation.

His guilt is utterly undeniable: by aiding and abetting Hillary’s repeated violations of multiple national security statutes, James Comey has disgraced himself, his Bureau and his country.  Every passing day sees more revelations regarding Hillary’s emails, all of which further expose the lies and misrepresentations contained in Comey’s conclusions.  Were we Donald Trump, we’d announce tomorrow Comey’s resignation is expected on our desk the day after our inauguration.

More importantly, the FBI’s refusal to bring Hillary to justice is simply the latest evidence that, as the late, great Jimmy Malone so eloquently observed…

2016 is the Flight 93 election: charge the cockpit or you die. You may die anyway. You—or the leader of your party—may make it into the cockpit and not know how to fly or land the plane. There are no guarantees. Except one: if you don’t try, death is certain. To compound the metaphor: a Hillary Clinton presidency is Russian Roulette with a semi-auto. With Trump, at least you can spin the cylinder and take your chances.

To ordinary conservative ears, this sounds histrionic. The stakes can’t be that high because they are never that high—except perhaps in the pages of Gibbon. Conservative intellectuals will insist that there has been no “end of history” and that all human outcomes are still possible. They will even—as Charles Kesler does—admit that America is in “crisis.” But how great is the crisis? Can things really be so bad if eight years of Obama can be followed by eight more of Hillary, and yet Constitutionalist conservatives can still reasonably hope for a restoration of our cherished ideals? Cruz in 2024!

Not to pick (too much) on Kesler, who is less unwarrantedly optimistic than most conservatives. And who, at least, poses the right question: Trump or Hillary? Though his answer—“even if [Trump] had chosen his policies at random, they would be sounder than Hillary’s”—is unwarrantedly ungenerous. The truth is that Trump articulated, if incompletely and inconsistently, the right stances on the right issues—immigration, trade, and war—right from the beginning.

…If conservatives are right about the importance of virtue, morality, religious faith, stability, character and so on in the individual; if they are right about sexual morality or what came to be termed “family values”; if they are right about the importance of education to inculcate good character and to teach the fundamentals that have defined knowledge in the West for millennia; if they are right about societal norms and public order; if they are right about the centrality of initiative, enterprise, industry, and thrift to a sound economy and a healthy society; if they are right about the soul-sapping effects of paternalistic Big Government and its cannibalization of civil society and religious institutions; if they are right about the necessity of a strong defense and prudent statesmanship in the international sphere—if they are right about the importance of all this to national health and even survival, then they must believe—mustn’t they?—that we are headed off a cliff…”

For inquiring minds who want to know, the Roman consul Publius Decius Mus sacrificed himself to the gods by “leaping upon his horse and dashing into the middle of the enemy” in a ritual that he believed would secure victory for his embattled army…which in fact it did.

While some well-intentioned but misguided Conservatives, such as Greg Weiner at the Library of Law & Liberty or David French at NRO, may disagree with Publius’ contemporary counterpart, we don’t.  And the lawless conduct of James Comey is yet another reason.

Besides, what’s their alternative: the candidate who blacks out under pressure?!?

Wearing a mask of virtue is done not to save one’s soul for eternity but to still feel good about enjoying privilege. The sneakers, jeans, and T-shirts or mafia-black outfits of Silicon Valley billionaires can compensate for their robber-baron sins of outsourcing, offshoring, and tax avoidance or simply their preference for apartheid existence with the fellow rich; for George Soros (currency manipulator and European financial outlaw), it is funding leftists who hate capitalists and rank financial speculators like him. A person from Mars who reviewed the long record of the Clintons – from the young women who fell into the lair of Bill’s predation, to the unapologetic greed from the 34-trillion-to-1 odds in Hillary’s cattle-futures con, to “Chancellor Bill” of Laureate University as the highest annually paid university head in education history, to the privileged lifestyle of huge estates and private jets, (some of it fueled by ensuring the Clinton Foundation would dispense only about 15 percent of its annual expenditures to charities) — would size up the couple as grasping Gilded Age plutocrats whose reactionary lifestyles reflected a lifelong counter-revolutionary self-obsession.

But it is not so. Hillary now amplifies Black Lives Matter (long forgotten is Bill’s racialist dismissal of a young Senator Obama). She has gone from border enforcer to the left of Barack Obama on immigration laxity, from Wall Street Journal free trader to blue-collar protectionist. And the result is that the richer, the more privileged, the more elitist, and more lawless the Clintons have become, the more insatiable become their appetitesand the more their souls find penance and are at peace.

What enrages the public about virtue-mongering is that, according to the laws of their own value system, the elite sin and then fob such failings off on others to find resolution. Kaepernick makes more in a month than most Americans whom he insults will make in a lifetime; and most Americans have never used the N-word to slur someone of color. Most Americans do not get rich off overseas coal plants like the green Tom Steyer did, or dump worthless cable channels to the Islamist and anti-Semitic Al Jazeera in order to get rich from carbon-exporting Qatar, in the fashion of the global-sermonizing Al Gore. None of us in the manner of the Clintons have boarded a Lolita Express jet or tried to peddle diplomatic passports to the wealthy and connected. I have never met an American who bought up all the homes surrounding his own to redefine his neighborhood as did Mark Zuckerberg, who derides walls and border enforcement for others. And yet we are lectured about our social-awareness failings ad nauseam by these masters of the progressive universe.

Laos refused to take back ex-con gunman who shot Fresno sheriffs

The convicted rapist who shot two corrections officers in Fresno, Calif., last week was an illegal immigrant who was only in the U.S. because his homeland refused to take him, federal officials confirmed Wednesday.

Thong Vang, a 37-year-old Laotian national who completed a 16-year rape sentence two years ago and was slated for deportation, instead was freed when Laotian officials did not respond to a request by Immigration and Customs Enforcement to assist in his removal.

“When Laotian officials failed to respond to that request, ICE released Mr. Vang in December, 2014 due to the Supreme Court’s ruling in Zadvydas v. Davis,” ICE spokeswoman Virginia Kice said.  The ruling Kice cited held that immigrants under order of deportation but whom no other country will accept may not be held indefinitely, absent special circumstances. Last year, 3,735 illegal immigrant criminals from Laos were ordered deported but instead freed when the country refused to cooperate.

“This is another horrifying example of the consequences of failing to push the issue of deportations with uncooperative countries,” said Jessica Vaughan, Director of Policy Studies for the Center for Immigration Studies. “Laos has been a problem for many years, and there are more than 3,700 criminals still here as a result, but still the State Department has not lifted a finger to take action against that government. Instead, they keep issuing visas – they gave out more than 11,000 temporary visas in the last five years in Laos, despite the requirement in federal law that they impose visa sanctions on countries that won’t take back their citizens.”

By contrast, some 67,792 Mexican nationals slated for removal could not be deported and nearly 29,000 Cubans were also freed after deportation failed.

The issue made national headlines in June, when the Inspector General for the Department of Homeland Security, ICE’s parent agency, blasted the department for not doing more to ensure deportation of a Haitian national who murdered a Connecticut woman after being released from prison. 

The Connecticut case prompted House Oversight Committee Chairman Jason Chaffetz, R-Utah, to blast the State Department at a July hearing for not doing more to force recalcitrant countries to take back their criminals. The law states that the State Department must stop issuing visas to citizens of such countries until they cooperate with removals“He should have automatically been deported back to his home country of Haiti after he was released from prison,” Chaffetz thundered. “But instead, he was released from custody because Haiti refused to take him back and we just accepted that. We just said, ‘Ok Haiti, we’ll go ahead and keep him here in the United States.’”…”
