Joel Coplin and his wife, Jo-Ann, were sleeping in their home above their downtown Phoenix art gallery when they were awakened by the loud blasts in front of their building. But they <strong><span style=\"text-decoration: underline;\"><em>did not<\/em><\/span><\/strong> rush to the window to see what was happening. They <strong><span style=\"text-decoration: underline;\"><em>didn\u2019t<\/em><\/span><\/strong> call the police. \u201cIt\u2019s gotten to the point where you <strong><span style=\"text-decoration: underline;\"><em>just roll over and put the pillow over your head<\/em><\/span><\/strong>,\u201d Coplin said of <strong><span style=\"text-decoration: underline;\"><em>living on the edge of \u201cthe Zone<\/em><\/span><\/strong>,\u201d one of the nation\u2019s largest homeless encampments.<\/p>\n<p style=\"padding-left: 30px;\">More than 1,000 people now call this site of <strong><span style=\"text-decoration: underline;\"><em>drugged-out bacchanalia<\/em><\/span><\/strong> their home. In the Zone, addicts <strong><span style=\"text-decoration: underline;\"><em>freely shoot up heroin and smoke meth and fentanyl<\/em><\/span><\/strong>, littering the grounds with needles and foil packets. They wander the streets like ghosts, lost in their delusions, and trade pills for sex, <strong><span style=\"text-decoration: underline;\"><em>often in plain sight<\/em><\/span><\/strong>. They relieve themselves <strong><span style=\"text-decoration: underline;\"><em>where they please<\/em><\/span><\/strong>, filling storm drains with human waste, rotten food, and garbage that flushes into the Rio Salado River Parkway <span style=\"color: #008000;\"><strong>(<em>Oh, the environmental calamity!!!<\/em>)<\/strong><\/span>.\u00a0They <strong><span style=\"text-decoration: underline;\"><em>beat<\/em><\/span><\/strong> one another, <strong><span style=\"text-decoration: underline;\"><em>rob<\/em><\/span><\/strong> one another. <strong><span style=\"text-decoration: underline;\"><em>Sometimes<\/em><\/span><\/strong> they <strong><span style=\"text-decoration: underline;\"><em>kill<\/em><\/span><\/strong> one another \u2014 at least four people were killed in the Zone last year, according to news reports. There have been multiple burned bodies in the encampment, including the burned body of a <strong><span style=\"text-decoration: underline;\"><em>newborn<\/em><\/span><\/strong> found dead in the street.<\/p>\n<p style=\"padding-left: 30px;\">Police <strong><span style=\"text-decoration: underline;\"><em>rarely enforce the law<\/em><\/span><\/strong>. <strong><span style=\"text-decoration: underline;\"><em>Instead<\/em><\/span><\/strong>, they provide vagrants around Phoenix with \u201c<strong><span style=\"text-decoration: underline;\"><em>courtesy rides<\/em><\/span><\/strong>\u201d into the Zone, allegedly to get services at a Human Services Campus on the grounds. It\u2019s become <strong><span style=\"text-decoration: underline;\"><em>so bad<\/em><\/span><\/strong> over the last several years \u2014 the gunshots, the misery, the death \u2014 that Coplin and his wife, both painters, shuttered their gallery. They can\u2019t risk bringing groups of people to the neighborhood for shows, even if they wanted to come.<\/p>\n<p style=\"padding-left: 30px;\">Coplin and his wife are among the plaintiffs who sued the city last year, seeking to <strong><span style=\"text-decoration: underline;\"><em>force<\/em><\/span><\/strong> Phoenix leaders to <strong><span style=\"text-decoration: underline;\"><em>clea<\/em><\/span><\/strong>r the Zone. In late March, Arizona Superior Court Judge Scott Blaney released a\u00a0<span style=\"color: #0000ff;\"><strong><span style=\"text-decoration: underline;\"><em><a style=\"color: #0000ff; text-decoration: underline;\" href=\"https:\/\/www.goldwaterinstitute.org\/wp-content\/uploads\/2023\/03\/The-Zone-ruling-preliminary-injunction.pdf\" target=\"_blank\" rel=\"noopener\" data-testid=\"standard-link\">preliminary ruling in their favor<\/a><\/em><\/span><\/strong><\/span>; the city has until July 10, the next court date, to clean up the mess that <strong><span style=\"text-decoration: underline;\"><em>it helped to create and to perpetuate<\/em><\/span><\/strong>. But lawyers who spoke to\u00a0<span class=\"small_caps\">National Review<\/span>\u00a0said Blaney\u2019s ruling <strong><span style=\"text-decoration: underline;\"><em>could<\/em><\/span><\/strong> have implications <strong><span style=\"text-decoration: underline;\"><em>outside<\/em><\/span><\/strong> of Phoenix and <strong><span style=\"text-decoration: underline;\"><em>far beyond<\/em><\/span><\/strong> Arizona\u2019s borders. The reasoning in his 23-page ruling, they said, could serve as a legal pathway for addressing the massive homeless encampments sprouting in parks and on sidewalks in big cities <strong><span style=\"text-decoration: underline;\"><em>across the country<\/em><\/span><\/strong>, <strong><span style=\"text-decoration: underline;\"><em>particularly<\/em><\/span><\/strong> on the <strong><span style=\"text-decoration: underline;\"><em>West Coast.<\/em><\/span><\/strong><\/p>\n<p style=\"padding-left: 30px;\">The ruling, they said, is significant for <strong><span style=\"text-decoration: underline;\"><em>two reasons<\/em><\/span><\/strong>: <strong><span style=\"text-decoration: underline;\"><em>One<\/em><\/span><\/strong>, it makes the case that the city can <strong><span style=\"text-decoration: underline;\"><em>legally<\/em><\/span><\/strong> take action to <strong><span style=\"text-decoration: underline;\"><em>enforce<\/em><\/span><\/strong> anti-camping laws, <strong><span style=\"text-decoration: underline;\"><em>despite<\/em><\/span><\/strong> a 2018 ruling out of the Ninth Circuit Court of Appeals that put <strong><span style=\"text-decoration: underline;\"><em>limits<\/em><\/span><\/strong> on enforcing camping bans on the homeless. And <strong><span style=\"text-decoration: underline;\"><em>two<\/em><\/span><\/strong>, it makes <strong><span style=\"text-decoration: underline;\"><em>clear<\/em><\/span><\/strong> that the city <strong><span style=\"text-decoration: underline;\"><em>must<\/em><\/span><\/strong> take action to \u201cabate the nuisance\u201d <strong><span style=\"text-decoration: underline;\"><em>it has allowed to grow<\/em><\/span><\/strong>.<\/p>\n<p style=\"padding-left: 30px;\">In his ruling, Blaney declared that the city of Phoenix is illegally \u201c<strong><span style=\"text-decoration: underline;\"><em>maintaining<\/em><\/span><\/strong> a public nuisance in the Zone\u201d \u2014 a <span style=\"text-decoration: underline;\"><em><strong>biohazard<\/strong><\/em><\/span> where crime is rampant and laws are enforced arbitrarily. He also took aim at one of the city\u2019s prime excuses for <strong><span style=\"text-decoration: underline;\"><em>not<\/em><\/span><\/strong> clearing the camp \u2014\u00a0<em>Martin v. Oregon\u00a0<span style=\"text-decoration: underline;\"><span style=\"color: #0000ff;\"><strong><em><a style=\"color: #0000ff; text-decoration: underline;\" href=\"https:\/\/olis.oregonlegislature.gov\/liz\/2023R1\/Measures\/Overview\/HB3501\" target=\"_blank\" rel=\"nofollow noopener\">House Bill 3501<\/a><\/em><\/strong><\/span><\/span>, known as the Right to Rest Act, states that homeless individuals will have &#8220;a privacy interest and a reasonable expectation of privacy in any property belonging to the person, regardless of whether the property is located in a public space.&#8221; The bill <strong><span style=\"text-decoration: underline;\"><em>also<\/em><\/span><\/strong> allows homeless individuals <strong><span style=\"text-decoration: underline;\"><em>to sue for up to $1,000<\/em><\/span><\/strong> if they are &#8220;<strong><span style=\"text-decoration: underline;\"><em>harassed&#8221; or told to relocate<\/em><\/span><\/strong>.<\/p>\n<p style=\"padding-left: 30px;\">The bill says that &#8220;persons experiencing homelessness&#8221; will &#8220;be permitted to use public spaces in the same manner as any other person without discrimination based on their housing status&#8221; and states that homeless individuals have a <strong><span style=\"text-decoration: underline;\"><em>right<\/em><\/span><\/strong> to &#8220;move freely in public spaces without discrimination and time limitations that are based on housing status.&#8221;<\/p>\n<p style=\"padding-left: 30px;\">&#8230;&#8221;I love Portland and I love where I live,&#8221; Portland homeowner Jacob Adams\u00a0told Fox &amp; Friends\u00a0in February in a plea to elected officials to do something about a homeless encampment next to his house, where fires and drug activity have terrorized his family.\u00a0&#8220;I&#8217;m asking you to <strong><span style=\"text-decoration: underline;\"><em>please do something<\/em><\/span><\/strong>, so the people of the city feel safe.&#8221;<\/p>\n<p><a href=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2023\/04\/Portland1-copy.png\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-109173\" src=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2023\/04\/Portland1-copy.png\" alt=\"\" width=\"462\" height=\"260\" srcset=\"https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2023\/04\/Portland1-copy.png 462w, https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2023\/04\/Portland1-copy-300x169.png 300w\" sizes=\"auto, (max-width: 462px) 100vw, 462px\" \/><\/a><\/p>\n<p style=\"padding-left: 30px;\">Armand Martens, an 83-year-old Vietnam veteran who also lives next to Adams,\u00a0<span style=\"color: #0000ff;\"><strong><em><a style=\"color: #0000ff;\" href=\"https:\/\/www.foxnews.com\/us\/portland-family-terrorized-fires-set-homeless-squatters-next-door-my-wife-was-screaming\" class=\"broken_link\">told a local outlet<\/a><\/em><\/strong><\/span>\u00a0he felt safer walking down the streets of Saigon than he does in Portland&#8230;&#8221;<\/p>\n<p><strong>Here&#8217;s the juice: There isn&#8217;t a &#8220;housing&#8221; crisis, nor are all but a <span style=\"text-decoration: underline;\"><em>tiny minority<\/em><\/span> of these individuals (think the percentage of the population who are <span style=\"text-decoration: underline;\"><em>truly<\/em><\/span>\u00a0suffering from gender dysphoria!) transitorily homeless.\u00a0 This &#8220;crisis&#8221;, created by Progressive politicians and policies, is almost <span style=\"text-decoration: underline;\"><em>exclusively<\/em><\/span> comprised of the drug-addicted and mentally-ill who <span style=\"text-decoration: underline;\"><em>refuse to follow rules or be subject to any restrictions<\/em><\/span> on their behavior <span style=\"text-decoration: underline;\"><em>whatsoever<\/em><\/span>.<\/strong><\/p>\n<p><strong>Case in point:<\/strong><\/p>\n<p style=\"text-align: center;\">\u00a0<script type=\"text\/javascript\" src=\"https:\/\/video.foxnews.com\/v\/embed.js?id=6326299624112&#038;w=462&#038;h=258\"><span data-mce-type=\"bookmark\" style=\"display: inline-block; vehicle.<\/p>\n<p class=\"speakable\" style=\"padding-left: 30px;\">The Hillsborough County Sheriff\u2019s Office\u00a0arrested Ricardo Guyton Jr. for armed trafficking of fentanyl, possessing a firearm as a felon <strong><span style=\"text-decoration: underline;\"><em>and<\/em><\/span><\/strong> child neglect. The sheriff\u2019s office said detectives with the department\u2019s Opioid Overdose Investigations (OOI) investigated Guyton\u2019s activities for two weeks before he was arrested.<\/p>\n<p style=\"padding-left: 30px;\">When deputies arrested Guyton on April 27, a press release from the sheriff\u2019s office read, he was allegedly in\u00a0possession of 14 grams of fentanyl, which is enough to kill 7,000 people, and a loaded handgun that was reported stolen from an unlocked vehicle in Temple Terrace in 2021.
