“Jill Biden, the wife of former Vice President Joe Biden who is presently running for the Democratic nomination for president, was busy on Sunday with a photo op helping to pass out food for the holiday.<\/p>\n

But she wasn\u2019t helping to distribute food to American homeless<\/em><\/span>.<\/span> She was in Matamoros, Mexico<\/em><\/span> helping to distribute food at an event for migrants who are waiting there, seeking asylum, most of whom will likely not qualify, if history is any judge.<\/span><\/span> (Nor, then, do they deserve<\/span> it!<\/em>)<\/span><\/strong><\/p>\n

Now, it\u2019s a good thing to feed anyone who might need it.<\/span>\u00a0According to Hot Air<\/em><\/span>,<\/span><\/a>\u00a0they distributed about 1500 meals which only fed about half the people there. Biden called it \u201cheartbreaking\u201d and said \u201cit\u2019s not who we are as Americans<\/em><\/span>.\u201d<\/span><\/span><\/strong><\/p>\n

But the folks waiting there are there voluntarily<\/em><\/span>, they can leave and go home<\/em><\/span>. And it\u2019s because of the policies of President Donald Trump that there now are fewer people crossing<\/em><\/span>, leading to fewer people waiting<\/em><\/span>, crossing dangerously or being detained.<\/span> That\u2019s far more effective as a policy than handing out food for a couple of hours or seemingly agitating for open borders<\/em><\/span>.<\/span><\/strong><\/span><\/p>\n

Shall we note the policies in place when her husband was in office in the Obama administration<\/em><\/span>? When they built<\/em><\/span> what they now decry as \u201ccages<\/em><\/span>,\u201d were responsible for a lot of hardship because their policies<\/em> incited the overwhelming influx and actually turned children over to human traffickers because they didn\u2019t check sufficiently on to whom they were turning them over<\/em><\/span>?<\/span> And didn\u2019t<\/em><\/span> resolve any<\/em><\/span> of the appreciable problems?<\/span><\/strong><\/span><\/p>\n

It\u2019s hard to look at it as much more than a political photo op to try to take a whack at Trump<\/em><\/span>, especially when there are Americans in need in so many Democratic cities<\/em><\/span>, for example San Francisco and Los Angeles, literally because of Democratic policies<\/em><\/span><\/strong><\/span>…”<\/p>\n

Not to mention Dimocratic states<\/em><\/span>…like Delaware<\/span><\/a><\/em><\/span>:<\/strong><\/p>\n

We seem to recall something about charity beginning at home; but then, dreary old Dimocratic-controlled Delaware doesn’t make nearly as effective a photo-op as connecting in Matamoros with the future<\/em><\/span> of the party.<\/strong><\/p>\n

“Queen\u00a0Nancy<\/em><\/span>\u00a0Pelosi\u00a0is not amused<\/em><\/span>. Having just demanded her subjects in the House\u00a0impeach the\u00a0president\u00a0in\u00a0a historic\u00a0and unprecedented party-line\u00a0vote, jeopardizing\u00a0the reelection of many and even threatening her own reign,\u00a0Her Royal Highness, aka the House Speaker,\u00a0grew testy\u00a0recently\u00a0with\u00a0inquisitive\u00a0reporters<\/em><\/span>.<\/span><\/strong><\/span><\/p>\n

Pelosi scolded<\/em><\/span> the pesky press for wanting to know why, for the first time in the nation\u2019s history<\/em><\/span>, she did not follow the accustomed path of handing the articles of\u00a0impeachment\u00a0over to the Senate for an expected trial<\/em><\/span>. Having to explain her bizarre decision was apparently beneath her; she cut off inquiries abruptly saying, \u201cAny other questions because I\u2019m not going to answer any more questions on this…I\u2019m not going to go there anymore<\/span><\/em>.\u201d<\/span><\/strong><\/span><\/p>\n

She stopped short of demanding \u201cOff with their heads!\u201d but from the look in her eye, it was only the cameras that\u00a0restrained her<\/span><\/em>.<\/strong><\/span><\/p>\n

It\u2019s no wonder<\/em><\/span> Queen Nancy\u00a0didn\u2019t want to answer questions\u00a0about her refusal to forward\u00a0the articles of impeachment.<\/span> There are no good explanations<\/em><\/span> except one: she wants to extend her\u00a0rule\u00a0to the Senate as well as the House<\/em><\/span>. She wants<\/em><\/span>, she says, to determine how the GOP-led Senate will conduct the trial, ostensibly to make sure it\u2019s \u201cfair<\/em><\/span>.\u201d<\/span><\/strong><\/span><\/p>\n

Never mind<\/em><\/span> that she has no constitutional authority for influencing the\u00a0Senate\u2019s procedures<\/em><\/span>. Never mind<\/em><\/span> that her insistence violates the very nature of a bicameral legislature<\/em><\/span>.<\/span> The Founding Fathers, who have been much quoted in recent days by Democrats attempting to justify their impeachment push, respected the separate duties and responsibilities<\/em><\/span> \u2013 the checks and balances \u2013 of the House and the Senate<\/em><\/span>. They created our system explicitly to prevent mob rule<\/em><\/span>.<\/span> In short, they envisioned exactly what is transpiring today<\/em><\/span><\/strong><\/span>…”<\/p>\n

The Ins and Outs of Delaying a Senate Impeachment Trial<\/span><\/span><\/a><\/h1>\n

“…The House Democrats most likely got their idea to delay sending their articles of impeachment over to the Senate from Harvard Law School\u2019s Professor of Constitutional Law Laurence H. Tribe. Professor Tribe has been a strong advocate for impeaching President Trump. Nevertheless, in an\u00a0op-ed column he wrote for the Washington Post<\/a><\/span><\/em><\/span>, Professor Tribe recommended delay in sending the impeachment articles to the Senate until there is clarification of the Senate trial rules. \u201cThis option needs to be taken seriously now that Majority Leader Mitch McConnell (R-Ky.) has announced his intention to conduct not a real trial<\/em><\/span> but a whitewash<\/em><\/span>, letting the president and his legal team call the shots<\/em><\/span>,\u201d Professor Tribe wrote.<\/span> He then disputed any constitutional objections to such a delay strategy. He opined that \u201cthe House, whose historical role is to prosecute articles of impeachment in the Senate after exercising its \u2018sole\u2019 power to impeach, is under no affirmative constitutional obligation to do so instantly<\/em><\/span>.\u201d<\/span><\/strong><\/span><\/p>\n

Professor Tribe\u2019s partisanship has clouded his judgment<\/em><\/span> on the Constitution\u2019s delegation of impeachment and trial powers to the House of Representatives and the Senate respectively. So, let\u2019s educate him<\/em><\/span> on some elementary points<\/em><\/span>.<\/span><\/strong><\/span><\/p>\n

Article I, Section 2 does indeed<\/em><\/span> say that the House of Representatives<\/em><\/span> \u201cshall have the sole Power of Impeachment<\/em><\/span>.\u201d The House exercised<\/em><\/span> its sole power of impeachment Wednesday night.<\/span> It\u2019s constitutional role in the process is done<\/em><\/span>. Now it\u2019s the Senate\u2019s turn<\/em><\/span>.<\/span> But Professor Tribe says not so fast.<\/strong><\/span><\/p>\n

Relying on Article I, Section 5 of the Constitution that says each<\/em><\/span> legislative chamber sets its own rules<\/em><\/span>,\u00a0Professor Tribe tweeted\u00a0that \u201cIt\u2019s up to the House when and how to prosecute its case in the Senate.\u201d<\/strong><\/span><\/p>\n

Yes, the Democrat-controlled House was free<\/em><\/span> to set its own one-sided rules governing its own impeachment process<\/em><\/span>. That was<\/em><\/span> its constitutional right, despite having exercised that right so irresponsibly in this case<\/em><\/span>.<\/span> But Professor Tribe neglected to mention<\/em><\/span> the power of the Senate<\/em><\/span> to decide when and how it will try impeachment cases<\/em><\/span>. Article I, Section 3 provides that \u201cThe Senate shall have the sole Power<\/span> to try all Impeachments<\/span><\/em>.\u201d<\/span><\/strong><\/span><\/p>\n
