fact, Ms. Rainey had <em><span style=\"text-decoration: underline;\">already<\/span><\/em> resigned her commission <em><span style=\"text-decoration: underline;\">prior to<\/span><\/em> participating&#8230;<em><span style=\"text-decoration: underline;\">out of uniform<\/span><\/em>&#8230;in a <em><span style=\"text-decoration: underline;\">lawful<\/span><\/em> exercise of her First Amendment rights guaranteed <em><span style=\"text-decoration: underline;\">every<\/span><\/em> American.\u00a0 Note Commie cadet Rapone was IN uniform&#8230;yet still wasn&#8217;t immediately weighted down with concrete blocks and thrown in the Hudson.<\/strong><\/p>\n<p><strong>We should note, despite keeping some 25 &#8220;cadets of color&#8221; on the football roster in violation of long-standing West Point guidelines declaring <em><span style=\"text-decoration: underline;\">anyone<\/span><\/em> charged with an honor offense ineligible for varsity sports competition, the Black Knights (no pun intended) of the Hudson still fell to the West Virginia Moutaineers in the Autozone Liberty Bowl&#8230;which is somehow fitting, since that&#8217;s the only place where most West Point grads\u00a0are qualified to work.<\/strong><\/p>\n<p><strong>But we digress!<\/strong><\/p>\n<p><strong>In a related item, writing at the <em>WSJ<\/em>, former assistant attorney for the District of #333399; text-decoration: underline;\">No, Trump Isn\u2019t Guilty of Incitement<\/span><\/span><\/a><\/h1>\n<h3 class=\"sub-head\" style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\"><a style=\"color: #ff0000;\" href=\"https:\/\/www.wsj.com\/articles\/no-trump-isnt-guilty-of-incitement-11610303966?mod=MorningEditorialReport&amp;mod=djemMER_h\"><span style=\"text-decoration: underline;\">Inflaming emotions isn\u2019t a crime. The president didn\u2019t mention violence, much less provoke it<\/span><\/a>.<\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/download-1-7.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-89274\" src=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/download-1-7.jpeg\" alt=\"\" width=\"420\" height=\"280\" srcset=\"https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/download-1-7.jpeg 420w, https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/download-1-7-300x200.jpeg 300w\" sizes=\"auto, (max-width: 420px) 100vw, 420px\" \/><\/a><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong>House Democrats have drafted an article of impeachment that accuses President Trump of \u201cincitement to insurrection.\u201d<span style=\"color: #ff0000;\"> Acting U.S. Attorney Michael Sherwin said Thursday that his office is \u201clooking at all actors here and anyone that had a role\u201d in the Capitol riot.<\/span> Some reporters have construed that as including Mr. Trump.<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong><span style=\"color: #ff0000;\">The president didn\u2019t commit incitement or any other crime.<\/span> <span style=\"text-decoration: underline;\"><em>I should know<\/em><\/span>. <span style=\"color: #ff0000;\">As a Washington prosecutor I earned the nickname \u201cprotester prosecutor\u201d from the antiwar group CodePink.<\/span> In one trial, I convicted 31 protesters who disrupted congressional traffic by obstructing the Capitol Crypt. <span style=\"color: #ff0000;\">In another, I convicted a CodePink activist who smeared her hands with fake blood, charged at then-Secretary of State Condoleezza Rice in a House hearing room, and incited the audience to seize the secretary of state physically.<\/span> In other cases, I dropped charges when the facts fell short of the legal standard for incitement. <span style=\"color: #ff0000;\">One such defendant was the antiwar activist Cindy Sheehan.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong><em><span style=\"text-decoration: underline;\">Hostile journalists and lawmakers<\/span><\/em> have suggested Mr. Trump incited the riot when he told a rally that Republicans need to \u201cfight much harder.\u201d <span style=\"color: #ff0000;\">Mr. Trump suggested the crowd walk to the Capitol: \u201cWe\u2019re going to cheer on brave senators and congressmen and -women, and we\u2019re probably not going to be cheering so much for some of them.<\/span> Because you\u2019ll never take back our country with weakness. <span style=\"color: #ff0000;\">You have to show strength and you have to be strong.\u201d<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong>In the District of Columbia, it\u2019s a crime to \u201cintentionally or recklessly act in such a manner to cause another person to be in reasonable fear\u201d and to \u201cincite or provoke violence where there is a likelihood that such violence will ensue.\u201d <span style=\"color: #ff0000;\">This language is based on\u00a0<em>Brandenburg v. Ohio\u00a0<\/em>(1969), in which <em><span style=\"text-decoration: underline;\">the Supreme Court set the standard<\/span><\/em> for speech that <em><span style=\"text-decoration: underline;\">could<\/span><\/em> be prosecuted without violating the First Amendment.<\/span> The justices held that a Ku Klux Klan leader\u2019s calls for violence against blacks and Jews were protected speech. <span style=\"color: #ff0000;\">The court found that Clarence Brandenburg\u2019s comments were \u201cmere advocacy\u201d of violence, not \u201cdirected to inciting or producing imminent lawless action&#8230;likely to incite or produce such action.\u201d<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong>The president <em><span style=\"text-decoration: underline;\">didn\u2019t mention violence<\/span><\/em> on Wednesday, <em><span style=\"text-decoration: underline;\">much less provoke or incite it<\/span><\/em>. <span style=\"color: #ff0000;\">He said, \u201cI know that everyone here will soon be marching over to the Capitol building to <em><span style=\"text-decoration: underline;\">peacefully<\/span><\/em> and patriotically make your <em><span style=\"text-decoration: underline;\">voices<\/span><\/em> heard.\u201d<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong>District law defines a riot as \u201ca <em><span style=\"text-decoration: underline;\">public disturbance<\/span><\/em>&#8230;<em><span style=\"text-decoration: underline;\">which by tumultuous and violent conduct or the threat thereof<\/span><\/em> creates grave danger of damage or injury to property or persons.\u201d <span style=\"color: #ff0000;\">When Mr. Trump spoke, there <em><span style=\"text-decoration: underline;\">was<\/span><\/em> no \u201cpublic disturbance,\u201d <em><span style=\"text-decoration: underline;\">only a rally<\/span><\/em>.<\/span> The \u201cdisturbance\u201d <em><span style=\"text-decoration: underline;\">came later<\/span><\/em> at the Capitol by a <em><span style=\"text-decoration: underline;\">small minority<\/span><\/em> who entered the perimeter and broke the law. <span style=\"color: #ff0000;\"><span style=\"text-decoration: underline;\"><em>They<\/em><\/span> should be prosecuted.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #333399;\"><strong>The president\u2019s critics want him charged for <em><span style=\"text-decoration: underline;\">inflaming the emotions of angry Americans<\/span><\/em>.<span style=\"color: #ff0000;\"><em><span style=\"text-decoration: underline;\"> That alone does not satisfy the elements of any criminal offense<\/span><\/em>, and therefore his speech is <em><span style=\"text-decoration: underline;\">protected by the Constitution<\/span><\/em> that members of Congress are sworn to support and defend.<\/span><\/strong><\/span><\/p>\n<p><strong>It&#8217;s also worth remembering last Wednesday&#8217;s mob wasn&#8217;t the first group to attack the Capitol looking to make a point, as evidenced by this photo of the Senate side following a 1983 bombing:\u00a0<\/strong><\/p>\n<p><a href=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/Capitol_1983_bombing_damage.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-89256\" src=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/Capitol_1983_bombing_damage.jpeg\" alt=\"\" decoding=\"async\" class=\"aligncenter size-full wp-image-89257\" src=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/rosenberg.png\" alt=\"\" width=\"420\" height=\"473\" srcset=\"https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/rosenberg.png 420w, https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/01\/rosenberg-266x300.png 266w\" sizes=\"auto, employed as vice chair of the board of directors of\u00a0<span style=\"color: #0000ff;\"><em><span style=\"text-decoration: underline;\"><a class=\"new broken_link\" style=\"color: #0000ff; text-decoration: underline;\" title=\"Thousand Currents (page does not exist)\" href=\"https:\/\/en.wikipedia.org\/w\/index.php?title=Thousand_Currents&amp;action=edit&amp;redlink=1\">Thousand #ff0000;\"><strong><span style=\"color: #0000ff;\">Watching America accept the <em><span style=\"text-decoration: underline;\">rationally and morally indefensible physical and economic lockdown of the country<\/span><\/em>, I concluded: &#8220;Apathy in the face of tyranny turns out not to be a German or Russian characteristic.<\/span> I just <em><span style=\"text-decoration: underline;\">never thought it could happen in America<\/span><\/em>.&#8221;<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\"><strong><span style=\"color: #0000ff;\">In <em><span style=\"text-decoration: underline;\">one week<\/span><\/em>, it has gotten <em><span style=\"text-decoration: underline;\">worse<\/span><\/em>.<\/span> Now we are faced with a <em><span style=\"text-decoration: underline;\">lockdown on speech<\/span><\/em> the likes of which <em><span style=\"text-decoration: underline;\">have never been seen in America<\/span><\/em>. <span style=\"color: #0000ff;\">And the parallels with Germany are <em><span style=\"text-decoration: underline;\">even more stark<\/span><\/em>.<\/span> The left-wing party (the Democrats) and the left-wing media (the &#8220;mainstream media&#8221;) are using the mob invasion of the Capitol <em><span style=\"text-decoration: underline;\">exactly the way the Nazis used the Reichstag fire<\/span><\/em>.<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\"><strong><span style=\"color: #0000ff;\">On Feb. 27, 1933, exactly <em><span style=\"text-decoration: underline;\">one month<\/span><\/em> after the Nazis came to power, the German parliament building, the Reichstag, was set ablaze.<\/span> The Nazis <em><span style=\"text-decoration: underline;\">blamed the fire on their archenemy<\/span><\/em>, the communists, and <em><span style=\"text-decoration: underline;\">used the fire to essentially extinguish the Communist Party and its ability to publish, speak or otherwise spread its message<\/span><\/em>. <span style=\"color: #0000ff;\">Using the Reichstag fire as an excuse, the Nazis passed the Enabling Act, a law that gave the Nazi chancellor, Adolf Hitler, <em><span style=\"text-decoration: underline;\">the power to pass laws by decree<\/span><\/em> \u2014 <em><span style=\"text-decoration: underline;\">without the Reichstag<\/span><\/em>.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff0000;\"><strong><em><span style=\"text-decoration: underline;\">Now<\/span><\/em> to <em><span style=\"text-decoration: underline;\">America 2021<\/span><\/em><\/strong><\/span>&#8230;&#8221;<\/p>\n<p><strong>You <em><span style=\"text-decoration:
