What Happened to Officer Sicknick<\/span><\/span><\/a>?<\/span><\/h1>\n

Democratic impeachment managers have a duty to explain how Officer Sicknick died<\/span><\/a>.<\/span><\/h3>\n

“I<\/strong><\/span><\/span>n<\/span>\u00a0its\u00a0article of impeachment, the Democrat-controlled House alleged that former president Donald Trump, by his \u201cincitement of insurrection,\u201d was responsible for murder<\/span><\/em>. That is an essential rationale<\/em><\/span> for impeaching Trump.<\/span> It is the most serious<\/em><\/span> accusation that has been leveled. The impeachment article states that, incited by Trump to storm the Capitol and \u201cfight like hell,\u201d Trump supporters \u201cinjured and killed<\/em><\/span> law enforcement personnel,\u201d among other heinous acts.<\/span><\/strong><\/span><\/p>\n

The accusation about killing law-enforcement personnel refers, of course, to Capitol police officer Brian Sicknick, who was pronounced dead on the night of January 7, more than 24 hours after the siege on the Capitol had ended.<\/strong><\/span><\/p>\n

Adding to the serious but vague accusation in the impeachment article, the Democratic House impeachment managers, who are the\u00a0prosecutors in the Senate trial<\/span>, elaborated in their publicly filed\u00a0pretrial memo\u00a0(at p. 28): \u201cThe insurrectionists killed a Capitol Police officer by striking him in the head with a fire extinguisher<\/span><\/em>.\u201d<\/strong><\/span><\/p>\n

It is noteworthy that the Democrats\u2019 pretrial memo was filed on February 2, nearly four weeks after<\/span><\/em> Officer Sicknick\u2019s death. Yet, during those four weeks, significant questions<\/span><\/em> about the impeachment managers\u2019 murder allegation have arisen.<\/span> It has been a bedrock principle<\/em><\/span> of American due process for over half a century<\/span><\/em> that if<\/span><\/em> prosecutors are aware of evidence that would tend to show an allegation they made is false, inaccurate, or at least incapable of being proved, they have an obligation<\/em><\/span> to disclose<\/em><\/span> that fact to the accused<\/span><\/em>.<\/strong><\/span><\/p>\n

So what is<\/span><\/em> the Democrats\u2019 proof<\/span><\/em> that Trump supporters murdered Officer Sicknick by bashing him over the head with a fire extinguisher<\/span><\/em>?<\/strong><\/span>…”<\/p>\n
