California Democratic lawmakers look to remove penalties for possessing a firearm during commission of a crime<\/span><\/span><\/a><\/h1>\n

“…The state lawmakers who backed the Anti-Racism Sentencing Reform Act claim<\/em><\/span> the existing law, which allows prosecutors to seek additional time behind bars, is racist<\/em><\/span> \u2014 89% of the roughly 40,000 inmates serving gun enhancement sentences in California are people of color,\u00a0according to figures from\u00a0Restore Justice. (Great, but even if true<\/span>, it’s a meaningless statistic<\/span>\u00a0without taking into account what percentage of those committing<\/span> gun crimes are people are color!<\/em>)<\/span><\/strong><\/span><\/p>\n

In California, the penalty for possessing<\/em><\/span> a firearm while committing serious crimes, like robbery and attempted murder, means an additional 10-year term<\/em><\/span> on top of the sentence for the underlying crime.<\/span> Shooting<\/em><\/span> a gun during the commission of the crime can add 20 years<\/em><\/span>, wounding<\/em><\/span> someone can add an additional 25 years<\/em><\/span> to life sentence.\u00a0<\/strong><\/span>The California bill would have reduced<\/em><\/span> those terms to one, two or a maximum of three years<\/em><\/span> and repealed any<\/span> gun enhancement<\/em> for some lesser crimes.<\/strong><\/span><\/p>\n

…“There’s ample research that long sentences don’t deter crime<\/em><\/span>. It’s actually the swiftness and the surety of consequences that deters crime, not<\/em><\/span> the length of the sentence,” said Restore Justice executive director Jobi Cates.<\/span> “The length<\/em><\/span> of the sentence just costs the state and communities and families hundreds of thousands and millions of dollars and destroys lives<\/em><\/span>. It doesn’t make us safer<\/em><\/span>.<\/span> It’s a myth<\/em><\/span>.”<\/strong><\/span><\/p>\n

Prosecutors call that a huge mistake, especially now as violent crime spikes around the country.<\/span> “The reason they should be sentenced more severely is the use of the gun greatly increases the danger that someone’s actually going to be killed<\/span><\/em>,” said Kent Scheidegger, legal director at the Criminal Justice Legal Foundation. “Certainly<\/span><\/em> a longer sentence for a habitual criminal does improve<\/span><\/em> public safety by preventing them from committing crimes during the time of the sentence<\/em><\/span>.”<\/span><\/strong><\/span>…”<\/p>\n

Soooo,…according to the Bleeding Hearts Club, the death penalty<\/span><\/em> doesn’t deter crime, and now long sentences<\/em><\/span> don’t deter crime?\u00a0 Sorry, but WTF DOES<\/span><\/em> deter crime: The prospect of becoming someone’s b*tch?!?<\/strong><\/p>\n
