text-decoration: underline;\">Federal judge tosses Bronx gun case over racial makeup of grand jury<\/span><\/span><\/a><\/h1>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6vtw.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-95015\" src=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6vtw.jpeg\" alt=\"\" width=\"420\" height=\"279\" srcset=\"https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6vtw.jpeg 420w, https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6vtw-300x199.jpeg 300w\" sizes=\"auto, (max-width: 420px) 100vw, 420px\" \/><\/a><\/p>\n<p style=\"padding-left: 30px;\">&#8220;<span style=\"color: #ff9900;\"><strong>A Manhattan federal judge dismissed a case against a reputed gang member in a shooting last year \u2014 because the suburban grand jury that indicted him wasn\u2019t diverse enough.\u00a0<span style=\"color: #0000ff;\">In a 36-page ruling, Judge Analisa Torres said defendant William \u201cIll Will\u201d Scott \u201cproduced clear statistical evidence\u201d that he was indicted by members of a grand jury pool in White Plains with an \u201cunderrepresentation of Black and Latinx individuals.\u201d<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff9900;\"><strong>Torres, who was nominated to the bench in 2013 by then-President Barack Obama, also said Scott had shown that the grand jury selection process \u201cwas susceptible to abuse.\u201d <span style=\"color: #0000ff;\">\u201cThe Government has failed to meet its burden by coming forward with evidence rebutting the presumption that such underrepresentation was the result of purposeful discrimination,\u201d she wrote Monday.<\/span><\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #ff9900;\"><strong>\u201cTherefore, Defendant has established a violation of his <em><span style=\"text-decoration: underline;\">Fifth Amendment right to a race-neutral jury selection process<\/span><\/em>.\u201d<\/strong><\/span>&#8230;&#8221;<\/p>\n<p><strong>For the record, here&#8217;s the text of the Fifth Amendment:<\/strong><\/p>\n<p style=\"padding-left: 30px;\">&#8220;<strong><em>No person shall be held to answer for a capital, or otherwise infamous crime, unless on a presentment or indictment of a Grand Jury, except in cases arising in the land or naval forces, or in the Militia, when in actual service in time of War or public danger; nor shall any person be subject for the same offence to be twice put in jeopardy of life or limb; nor shall be compelled in any criminal case to be a witness against himself, nor be deprived of life, liberty, or property, without due process of law; nor shall private property be taken for public use, without just compensation<\/em>.<\/strong>&#8220;<\/p>\n<p><strong>We know we&#8217;re just a sea lawyer rather than a JD, but we somehow missed the part where it says a gangbanger&#8230;or <span style=\"text-decoration: underline;\"><em>anyone else<\/em><\/span>&#8230;has the right to a <span style=\"text-decoration: underline;\"><em>race-neutral jury selection process<\/em><\/span>, a concept which in no uncertain terms <span style=\"text-decoration: underline;\"><em>predetermines<\/em><\/span> a Caucasian incapable of fairly weighing the facts in a case involving a Black.<\/strong><\/p>\n<p><strong>Then again, we&#8217;ve yet to find the mythical right to privacy emanating from a penumbra in the Constitution which issued from Harry Blackmun&#8217;s a*s guaranteeing a woman&#8217;s right to slaughter her unborn child.<\/strong><\/p>\n<p><strong>In a related item of judges allowing their feelings to trump the Constitution and the rule of law, we learn Brett Kavanaugh is fast becoming part of the problem rather than the solution as the <em>WSJ<\/em> informs us the&#8230;\u00a0<\/strong><\/p>\n<h1 class=\"wsj-article-headline\" style=\"padding-left: 30px;\"><span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.wsj.com\/articles\/supreme-court-declines-to-lift-national-eviction-moratorium-11625007863?mod=djemalertNEWS\"><span style=\"text-decoration: underline;\">Supreme Court Declines to Lift National Eviction Moratorium<\/span><\/a><\/span><\/h1>\n<h3 class=\"sub-head\" style=\"padding-left: 30px;\"><span style=\"color: #800000;\"><a style=\"color: #800000;\" href=\"https:\/\/www.wsj.com\/articles\/supreme-court-declines-to-lift-national-eviction-moratorium-11625007863?mod=djemalertNEWS\"><span style=\"text-decoration: underline;\">High court rejects landlords&#8217; emergency request to suspend enforcement of moratorium imposed by CDC<\/span><\/a><\/span><\/h3>\n<p>&nbsp;<\/p>\n<p><a href=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6l0r-1.jpeg\"><img loading=\"lazy\" decoding=\"async\" class=\"aligncenter size-full wp-image-95011\" src=\"http:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6l0r-1.jpeg\" alt=\"\" width=\"420\" height=\"234\" srcset=\"https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6l0r-1.jpeg 420w, https:\/\/www.thedailygouge.com\/wp-content\/uploads\/2021\/07\/5f6l0r-1-300x167.jpeg 300w\" sizes=\"auto, (max-width: 420px) 100vw, 420px\" \/><\/a><\/p>\n<p style=\"padding-left: 30px;\">&#8220;&#8230;<span style=\"color: #0000ff;\"><strong>The issue split the high court on a 5-4 vote, with Chief Justice John Roberts and Justice Brett Kavanaugh joining with the court\u2019s three liberal justices to leave the moratorium in place. <span style=\"color: #800000;\">The court\u2019s action came in a brief order.<\/span> As is typical in emergency appeals, the court <em><span style=\"text-decoration: underline;\">didn\u2019t explain its reasoning<\/span><\/em>.<\/strong><\/span><\/p>\n<p style=\"padding-left: 30px;\"><span style=\"color: #0000ff;\"><strong><span style=\"color: #800000;\">Justice Kavanaugh issued a one-paragraph concurrence explaining his views, saying <span style=\"text-decoration: underline;\"><em>he believed the moratorium was unlawful<\/em><\/span> but <span style=\"text-decoration: underline;\"><em>was willing to leave it in place for July<\/em><\/span>.<\/span> He said the moratorium would allow for \u201cadditional and more orderly distribution\u201d of rental-assistance funds appropriated by Congress<\/strong><\/span>&#8230;&#8221;<\/p>\n<p><strong>Sorry, but Kavanaugh&#8217;s disregard for the law leaves inquiring Conservative minds wondering&#8230;<\/strong><\/p>\n<p style=\"text-align: center;\"><iframe loading=\"lazy\" title=\"YouTube video player\" src=\"https:\/\/www.youtube.com\/embed\/Y2K75x9jXNo?start=491&amp;end=493&amp;\" width=\"420\" height=\"235\" frameborder=\"0\" allowfullscreen=\"allowfullscreen\"><span data-mce-type=\"bookmark\" style=\"display: inline-block;
